What awaits Royal AM’s new buyer

Royal AM's imminent sale will come with the new owners inheriting the club's debts – notably that of Samir Nurkovic.

The troubled club has reportedly already been placed on auction with all interested parties to purchase to open on Friday with the successful bid then being provisionally announced on Monday, March 17.

According to the invitation to submit offers, Royal AM is being sold as a going concern in terms of the proposed offer to purchase and in accordance with any amendments agreed to by the Curator Bonis.

A refundable deposit of R1 million must be paid to validate the offer for submission and offer documents must include proof of the bidder's ability to meet financial commitments plus the required FICA documentation.

While all the processes relating to the sale play out, the big matter relating to Nurkovic will be of relevance.

"From our end, whoever buys the club will inherit the debts, which includes what needs to be paid to Samir," says Davor Lazic, who is Nurkovic's legal representative.

"I suppose the prospective buyers will do due diligence.

"Until the moment they settle what is owed to Samir, the ban is binding and final and they will not be able to register players.

"The ban remains in place and the case has been exhausted in as far as all the avenues are concerned.

"There needs to be a solution for the sake of everyone involved," he adds.

Royal AM have missed out all their deadlines to comply with world governing body – FIFA – and the Court of Arbitration for Sport's rulings.

According to the 21-page arbitral award by CAS, which is in possession of KickOff.com, the club owes Nurkovic what is now approximately R11,2 million plus other costs related to the case to be determined by the CAS office, including a CHF20 000 (approx. R416 000) fine.

This fine relates to their failure to respect FIFA's decision – upheld by CAS – to pay the Serbian.

Now under curatorship of the South African Revenue Service (SARS), Thwihli Thwahla have not played any football this year with all their fixtures suspended until further notice.

Royal AM's appeal at CAS was classified as inadmissible with all other and further motions and prayers for relief dismissed.

The club also lost another case at FIFA against Brazilian defender Ricardo Nascimento.
