Why Esperance have a case against Sundowns

After Esperance wrote a letter of complaint against Mamelodi Sundowns following fan violence, a lawyer has hinted why Esperance could have a case.

There violent and chaotic scenes at Loftus Versfeld Stadium on Tuesday afternoon, following a CAF Champions League encounter quarter-final first-leg between Masandawana and Esperance.

Following a clash and fight between the two sets of fans, there were a few supporters who were reportedly admitted to the hospital.

The four-time champions have since wrote to CAF, complaining that they felt exposed to violence in Pretoria.

One of the biggest factors that CAF are likely to look at is, whether there was adequate security at Loftus Versfeld Stadium, as the security personnel at the venue were overpowered by the chaotic scenes.

"In December 2024, Equatorial Guinea was charged by CAF for failing to provide adequate security during its Total Energies CAF Africa Cup of Nations Morocco 2025 qualifiers' match against Togo on 14 November 2024 in Malabo, Equatorial Guinea," Lesedi Mphahlele, Attorney and Director at Fairbridges Wertheim Becker Attorneys wrote to KickOff on the issue of inadequate security.

"CAF found the country guilty of the breach and imposed a suspended sanction of USD 25,000. Additionally, a USD5,000 fine was levied due to the lack of security, which led to supporters invading the pitch during the match.

This ruling serves as a warning to other hosts, including Mamelodi Sundowns, who may face similar penalties if found guilty of failing to provide sufficient security, particularly in response to incidents of violence, as occurred during their first-leg CAF Champions League match against Esperance," Mphahlele stated.

"In conclusion, maintaining stadium safety and promoting sportsmanship are essential components for ensuring that football remains a safe and enjoyable experience for all parties involved.

"The rise in anti-sportsmanship behaviour poses significant challenges to organisers and governing bodies like CAF.

"It is crucial for clubs, federations, and local authorities to take proactive steps in risk mitigation, such as identifying high-risk matches, improving spectator management, and enhancing security protocols. By working together, stakeholders can foster a culture of respect, safety, and fairness that ensures that African football remains a source of unity and enjoyment for all," Mphahlele added.
