‘Royal AM transfer ban could be upgraded to points deduction’

DStv Premiership club Royal AM are still faced with the prospect of having their transfer ban reviewed to a points deduction that has the effects of relegation.

Royal AM have not been able to make signings through the current transfer window after being slapped with a FIFA imposed transfer ban.

The ban came into effective after failure to pay Samir Nurkovic his dues after winning his breach of contract case at FIFA.

Nurkuvic is owed an amount stretching into several millions of rands which is continuing to earn interest at the prescribed rate of 5% per annum.

 Royal AM have chosen to pursue the route of using the full length of the legal options available to them and have now elevated 'the substance of the case' through to the Court of Arbitration for Sport (CAS) in the hope of having the FIFA decision overturned.

The weight of the transfer ban has been evident with the club sitting second from bottom and having a squad that will be stretched to extremes with none of the eight departures to date having been replaced.

"The case is ongoing and without time limits having been escalated to CAS by the club because it is within their rights to pursue the matter further and we might end up in Lausanne (Switzerland)," says Davor Lazic, who is Nurkovic's representative.

"It is their decision to do what they have done and I'm not sure why they have gone this far after ruining their reputation with the statements that they made.

"Now, it is known that they don't pay players and they now cannot sign players because they have done this damage.

"Right now, they are faced with a transfer ban but then can also still be moved to a points deduction which will obviously have severe effects on them.

"I can motivate to FIFA to take points out of them as well because that option is also available.

"The transfer ban is merely a preliminary sanction, but more sanctions could be imposed if they continue to act this way. 

"Even with the transfer ban it can only be lifted once they have made payment and we communicate that to FIFA.

"Contrary to the statement they released that the transfer ban has been lifted there was never such because I also received the same letter that they got which is why the sanction remains on.

"CAS must now rule in relation to substance of the case but have already declined the uplifting of the transfer ban imposed by FIFA.

"It is all procedural and they will take the club's appeal.

"From my end they will still make the payment at a later stage with interest and legal expenses which comes with the CAS costs of filing a case with them.

"If they left this matter with FIFA, then that would have been of no cost to the opposing side, but they now must make payments for the arbitrators.

"I don't see how CAS will rule against the player because CAS normally goes with the FIFA decision.

"They are appealing against two respondents which is FIFA and our camp, but their arguments will not do any good for their club.  

"I would like to end up in a hearing with them to put out this case which I now find strange," says Lazic.
