Safpu application struck off roll

The case between the South African Players Union [SAFPU] and their former deputy secretary general Taelo Calvin Motloung was struck off the roll by the Court in Cape Town on Wednesday.

Motloung wanted the organisation's elections that took place in Cape Town recently to be nullified as he suspected foul play.

"The case didn't go well my brother, it was struck off the roll based on urgency," Motloung tells KickOff.

"Remember me and my team had applied for an urgent application for the court to interdict.

"Meaning the new leadership must not implement anything until the matter is heard.

"So now the court started with that and said 'You know what, you guys applied for urgency, and the way you did it you did not comply...you are actually late. 

That thing should have been done before congress. So as we speak now you are late, So based on that we are striking it off the roll. We are not going to hear you guys on an urgent basis.'

"The case is not over though, it's just that they did not hear the merits as they did not argue the merits of the case. That was just on the urgency.

"So the case is still there it's still on. It's just that the courts are going for recess now. Since it's December.

"So of course I'm still pursuing the case.

"The judge finished by saying it's strucked off the roll, So it's up to me if I continue with the case or not.

"And personally I want the merits of the case to be heard, because I believe constitution was violated.

"So the case has not sat, it's just that it was threw out because we were late for urgency.

"Justice has not been done yet. My claim was the violation of the constitution. They did not follow the constitution in having the congress."
