Lawyer explains PSL resolution PSL on Royal AM membership

After the PSL's recommendation for Royal AM membership to be "cancelled", KickOff spoke to a sports lawyer to explain the circular sent to member clubs.

In a circular addressed to "All Chairpersons, all Chief Executive Officers and all member clubs of the NSL", which this website is in possession of, the League made a resolution that:

"The Executive committee today (2 April) resolved to recommend the cancellation of the membership of Royal AM to the Board of Governors of the League...", as a conclusion after giving reasons.

We spoke to a sports lawyer - also an expert on NSL rules - Tyrel Singh, on what this resolution means and what what the next step is.

"The PSL Executive Committee, in accordance with Article 14.6 of the NSL Handbook, has resolved to recommend to the Board of Governors the cancellation of Royal AM Football Club's membership following a sale, transfer, or disposition conducted in contravention of this provision," Singh, a sports lawyer for SA Sports Law Association, explained, exclusively to this website.

"Should the Board of Governors uphold this recommendation, Royal AM and its owners will be subject to the restrictions set out in Article 14.7, which prohibit the club from acquiring a controlling interest or shareholding in any PSL member club for a period of 24 months from the date of its winding up.

"This measure underscores the League's commitment to regulatory compliance and the integrity of club ownership structures," he shared. 

Singh went on to clarify what the resolution to cancel Royal AM's membership implies.

"It is important to clarify that this resolution does not, in itself, constitute the cancellation of Royal AM's membership but rather initiates the formal process for such action.

"The next procedural step requires that Royal AM, along with all PSL member clubs, be given due notice of the forthcoming Board of Governors meeting, where a final determination on the Executive Committee's recommendation will be made.

"This ensures procedural fairness and adherence to the governance framework of the League."

Singh is an Executive committee member of the SA Sports Law Association, as the research officer.
